Westcott Cars Limited its Staff, Drivers, Contractors and Subcontractors hereinafter referred to in this document as Westcott Cars Limited.
1. Westcott Cars Limited makes this Website available to you to provide information about its business, and the services available with them. We have also teamed up with various partners to provide you with information which we think may be of interest to you.
2. These Terms only apply to your viewing of this Website. If you use one of the links on this Website to visit one of our partner websites, then please note that your viewing of these websites and any purchases made through them will be subject to separate terms and conditions.
3. Please read these Terms carefully. If you access the Website we will assume that you agree to the Terms. If you do not agree with these Terms, do not access or use the Website.
4. Westcott Cars Limited will endeavour to get you to your destination on time however do not accept any responsibility in any way either stated and/or implied for getting you to your destination by a set time, i.e. missed flights or trains etc. for whatever reason i.e. traffic delays, accidents, breakdowns, severe weather conditions or any unforeseen circumstances
5. All bookings are to be confirmed by the booker/passenger by phone or via email. The booking is only confirmed once the booker/passenger is in receipt of a Booking Confirmation email, or telephone call. Until then the booking is not confirmed.
6. We provide 45 minutes of free waiting time, commencing from the flight arrival time. Any time spent waiting there after the first 45 minutes will incur a charge of £15 per hour for a maximum of 3 hours. If the passenger has not arrived or attempted to contact the driver within the 3 hours since landing, the driver will leave the airport and a charge of 100% of the original quotation plus VAT and all charges incurred will be charged to the Credit Card which was provided at the time of booking.
7. Westcott Cars Limited drivers monitor the flights through the airport internet sites, airport information & mobile phones. In general the passenger will be the first to know of cancellations or delays. Although all UK airport information is updated every 30-45mins occasionally information can be delayed. In these situations please contact Westcott Cars Limited on the number provided to keep them updated of any changes.
8. CANCELLATION POLICY: In the event that you wish to cancel your booking, we request at least 24hrs notice. We must receive written cancellation by email or telephone. There will be no charge for this. However, if a cancellation is made with less than 24hrs notice a charge of 50% will be charged will be levied. If you fail to notify Westcott Cars Limited of a cancellation and choose not to turn up for the booking a charge of 100% of the original quotation (including any parking, and waiting time) will be charged.
9. It is essential that once you receive your Booking Confirmation Email, or by phone you check all booking details. Westcott Cars Limited cannot be held responsible for any errors which have been incurred. It is the responsibility of the passenger/booker to check all information at the time of receipt and to request any amendments/alterations to the Booking Confirmation, if errors are evident.
10. We accept payment by Cash or Cheque, or if an account has been previously set up then you can charge your account. All Accounts are charged plus VAT.
11. Westcott Cars Limited employs experienced & licensed drivers to provide a safe, friendly and professional transfer service at the approval of Westcott Cars Limited only.
12. If the driver is unable to find you at the airport, he will make several attempts to contact you via mobile/cell phone (numbers provided at time of booking). If he is still unable to reach you, a call will be put out at the information desk in the name of the passenger. Once the driver has made all attempts to contact you and luggage has been cleared from the flight (and the information board is showing the flight has cleared), the driver will leave the airport. This will be noted as a 'No Show' and you will be charged accordingly.
13. All bookings must be made through the Westcott Cars Limited booking office or via our website. If you, the booker/passenger make a booking direct with a driver, Westcott Cars Limited cannot be held responsible for the booking (unless you are in receipt of the adjusted Booking Confirmation Email or Airport Return Form).
14. westcottcars.co.uk content, including the information, names, images, pictures, logos and icons regarding or relating to Westcott Cars Limited and or its drivers and services (or to third party products and services), is provided "AS IS" and on an "AS AVAILABLE" basis. To the extent permitted by law, Westcott Cars Limited excludes all representations and warranties (whether express or implied by law), including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. Westcott Cars Limited does not guarantee the timeliness, completeness or performance of the website or any of the content. While we try to ensure that all content provided by Westcott Cars Limited is correct at the time of publication no responsibility is accepted by or on behalf of Westcott Cars Limited for any errors, omissions or inaccurate content on the website.
15. Nothing in these terms limits or excludes Westcott Cars Limited liability for death or personal injury caused by its proven negligence.
16. Subject to the previous sentence, Westcott Cars Limited shall not be liable for any of the following losses or damage (whether such damage or losses were foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of westcottcars.co.uk regardless of the form of action.
17. Westcott Cars Limited do not warrant that functions available on westcottcars.co.uk will be uninterrupted or error free, that defects will be corrected, or that westcottcars.co.uk or the server that makes it available are free of viruses or bugs. You acknowledge that it is your responsibility to implement sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements for the accuracy of data input and output.
18. Westcott Cars Limited holds no responsibility for the content or safety of any website that it has links to and has no control over these websites in any way.
19. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive and continue to be binding and enforceable.
20. Intellectual Property Rights
a. All trade marks, copyright, database rights and other intellectual property rights (together "the Rights") in the materials on this Website (as well as the organisation and layout of this Website) and the Rights in any software or underlying software code that is made available for download from the Website ("Software") are owned by us or our licensors.
b. Except as stated in paragraph 20.d. below, without our prior written permission, you may not copy, reproduce, modify, alter, publish, broadcast, distribute, display, post, sell, transfer or transmit in any form or by any means any material on this Website or Software whether in whole or in part nor use the material or Software to create derivative works.
c. The contents of the pages contained in this Website may not be distributed, displayed or copied to third parties including, but not limited to, "caching" any material on this Website for access by third parties and "mirroring" any material on this Website.
d. The contents of individual pages of this Website may be printed or downloaded to disk for the purpose of private and personal non-commercial use. You may make an electronically stored, transient copy of the content of this Website for the purpose of viewing it while connected to the Internet only.
21. You may not do any of the following without our written permission:
a. remove the copyright or trade mark notice from any copies of content under these Terms; or
b. create a database in electronic or structured manual form by systematically downloading and storing any content.
22. The failure or delay of Westcott Cars Limited to exercise or enforce any right in these terms does not waive Westcott Cars Limited right to enforce that right.
23. These terms shall be governed by and interpreted in accordance with the laws of England and Wales which shall have exclusive jurisdiction over any disputes.
